The money wrongfully obtained by Tui Namosi Ratu Suliano Matanitobua could have been used to upgrade schools in Namosi.
High Court judge Justice Dr Thushara Kumarage said this while delivering his sentence to a packed courtroom, full of Ratu Suliano’s people and supporters yesterday.
Ratu Suliano was handed a 36-month prison sentence — of which 26 months are to be served in custody with a non-parole period of 20 months.
The remaining 10 months were suspended for five years.
Justice Kumarage said the money could have been used to buy shoes for children dreaming to play in the national team one day, or to train health professionals.
He said in the commission of the offences Ratu Suliano breached the public trust, and that in light of his position as an MP for several years, the court was of the view that he was aware of the trust placed in him by the public, and that he had a responsibility to the Constitution through the oaths of office and allegiance he took in Parliament.
He also said the trust placed in him by the public was of the highest degree and so was the offending in their eyes.
He said by his conduct, Ratu Suliano damaged the reputation of Parliament, which could also reduce confidence in the democratic system of Fiji.
He also said it was the contention of the Fiji Independent Commission Against Corruption that the $38,378.22 obtained by Ratu Suliano by his claims, were made without any expense at all.
Justice Kumarage said the court took notice of Ratu Suliano’s previous good character, the health of his wife and the professional conduct of defence counsel Filimoni Vosarogo and his associates.
