Second witness takes stand in rape trial

THE boyfriend of the complainant in the Amenoni Nasilasila rape trial had told her to report the matter as he was furious and angry when he heard about what had happened.

Mitieli Mataibau was the second witness to take the stand in the trial of former Fiji sevens rugby speedster that began at the High Court in Lautoka yesterday.

During cross-examination by defence lawyer Mark Anthony, Mr Mataibau, a police officer by profession, said he was angry after his girlfriend relayed the allegation to him.

Mr Mataibau said he accompanied her to the Sigatoka Police Station to lodge a complaint because the matter was serious.

He also revealed to the court he believed his girlfriend was telling the truth because she had started crying while relaying the allegation to him.

The court was told that Nasilasila and the complainant had known each other since 2017 when they met in the United States of America.

It was also revealed that they had met for about six times before the alleged incident happened in Olosara, Sigatoka on December 22, 2018, where she was residing after coming to Fiji for a five-month break to visit her grandmother.

The case, however, was stood down for 15 minutes as Justice Daniel Goundar ordered the complainant to take a break after she could not control her emotions when taking the witness stand.

During the trial, the 24-year-old said she was weak and scared and could not fight back as she believed he would have done something serious to her because he was intoxicated at the time of the incident.

She also told the court that she ran to the bathroom to escape so she could lock the door, however, Nasilasila quickly followed her in, pushed her to the floor and allegedly raped her.

Defence counsel Mr Anthony quizzed the complainant on why she did not shout or scream for help as there were neighbours around.

She maintained that she was scared and shocked over what had happened and locked herself in the bathroom.

The complaint was also asked in her cross-examination by Mr Anthony as to why she had apologised to Nasilasila’s mother the day after lodging the official police complaint and she told the court that she did so because they had a relationship once.

She also informed the court that she still had feelings for him as they had a relationship once which finished in early 2018.

The trial continues today.
