Man fit to take plea, judge rules

A 21-YEAR-OLD man, who is charged with murder and receiving treatment at the St Giles Hospital, has been declared fit to take his plea, according to the psychiatric evaluation report tendered at the High Court in Suva yesterday.

Fabiano Dakai was not produced in court before judge Justice Aruna Aluthge yesterday.

The court was informed that the accused was kept at the St Giles Hospital and was receiving treatment.

Defence lawyer Namrata Mishra requested if a fresh production order could be issued for her client to be presented in court on the next court date.

She also said the prosecution had been provided a report by the St Giles Hospital on her client’s condition on December 31.

She said the defence just received the report yesterday and she needed time to go through it.

State lawyer Kimberly Semisi informed the court that the report concluded that the accused was aware of and able to participate in court proceedings, however, Ms Mishra pointed out that the report also highlighted that the accused had a history of mental illness.

Justice Aluthge issued a fresh production order for the accused and informed the court that the accused would continue to be remanded at the St Giles Hospital.

Mr Dakai is accused of murdering a 34-year-old security guard of Waidradra, outside Navua, on February 4, 2018.

The matter will be called on February 12.
