High Court overturns decision in miner’s compensation case

THE High Court in Lautoka has overturned a decision to award $24,000 in Workmen’s Compensation to the family of former Emperor Gold Mine carpenter, Barma Nand, who suffered a heart attack while working at the mine on October 1997.

In their appeal against the judgement by the Nadi Magistrates Court in March, 2007, the company argued that the court erred in law and in fact when finding liability to pay compensation under the Workmen’s Compensation Act (WCA) against the weight of the medical evidence supporting the employer’s case that Mr Nand’s death did not arise in the course of his employment.
