FLS notes remarks by Akbar

The Fiji Law Society (FLS) says it has noted with concern the remarks reportedly made by Minister Rosy Akbar at a recent meeting on the National Action Plan Against Violence Against Women.

In a statement issued by president Wylie Clarke, the FLS said Ms Akbar’s statement included a reminder to the judiciary of its role in domestic violence cases and that she lobbied the audience of judges and magistrates “for stricter measures in every single case of domestic violence and sexual offences because it could save lives”.

In response the Office of the Director of Public Prosecutions expressed concern at Ms Akbar’s comments, and said sentencing was a judicial function, not a political one.

“The Fiji Law Society supports the position of the Office of the DPP,” Mr Clarke said.

He said the Fiji Law Society shared the minister’s concerns about the prevalence of sexual, physical and other forms of violence against women and children in Fiji, “which is one of our country’s most serious social challenges” and supported wide public debate on causes and possible solutions.

“It is inappropriate, however, for a minister – an officer of the executive arm of the State — to “lobby” the judiciary to impose stricter sentences.”

Mr Clarke said the separation of powers between the executive and judicial arms of the State must be respected.

“In the society’s view, sentencing matters must be left to the discretion of the judiciary.”
