Fiji hotel developer makes court appearance

A MALOLO Island hotel developer accused of allegedly breaching the Environment Management Act appeared at the Nadi Magistrates Court yesterday.

Freesoul Real Estate Development (Fiji) Pte Ltd was represented by project officer Saula Sovanivalu.

He appeared before Magistrate Peni Dalituicama while the State was represented by lawyers from the Office of the Director of Public Prosecutions (ODPP).

According to the ODPP, the State had requested for more time to file further disclosures in the case.

Mr Dalituicama granted the application, adjourning the case to April 26.

The resort developers were charged with one count of undertaking unauthorised developments and one count of failure to comply with a prohibition notice under the Environment Management Act 2005.

Charges were sanctioned by the DPP in February after an inquiry by the Ministry of Environment.

The charges relate to the failure to comply with a prohibition notice issued by the Ministry of Waterways and Environment in June last year and to the carrying out of resort development activity without an approved environment impact assessment report.
