The Fiji Independent Commission Against Corruption (FICAC) is considering making a complaint to the Chief Registrar about the conduct of Suva lawyer Simione Valenitabua.
FICAC commissioner Rashmi Aslam said this in the Anti-Corruption Division of the High Court yesterday when Opposition member of Parliament Salote Radrodro’s trial was due to commence, but has been delayed because of an application filed by Mr Valenitabua, her lawyer.
Mr Valenitabua said the defence was filing voire dire grounds, challenging some elements of the offending, particularly the alleged conduct of Ms Radrodro.
He said documents FICAC intended to use to show that Ms Radrodro was not where she said she was, would contravene her Constitutional right to freedom of movement and were not admissible in court.
He said FICAC intended to use Ms Radrodro’s phone records and travel documents for that purpose.
Mr Aslam said it was for FICAC to prove the charges beyond a reasonable doubt and FICAC would prove them. He said this was just a delaying tactic, bordering professional misconduct.
