Dakuvula granted leave to advertise petition

THE affidavit of service filed was not good enough, a petitioner was told by High Court judge Justice Kamal Kumar yesterday.

Jone Dakuvula was ordered on Wednesday by the Court of Disputed Returns to serve the election petition against the 2018 General Election results personally on three respondents who have not been served.

Mr Dakuvula informed the court that he was yet to serve the petition on former FijiFirst MP Faiyaz Koya, Attorney-General Aiyaz Sayed-Khaiyum and Prime Minister Voreqe Bainimarama.

He said he had served the petition on the Electoral Commission and the Supervisor of Elections.

In a ruling yesterday, Justice Anjala Wati and Justice Kumar granted Mr Dakuvula leave to advertise the said petition in The Fiji Times newspaper today or tomorrow.

Justice Wati further instructed Mr Dakuvula that the affidavit of service must be filed on or before 9.30am on December 17, 2018.

She said the affidavit of service must include the paper cutting which states that he had advertised the petition and his notice must include the date and time for the respondents to appear in court.

She said the notice must state that the matter would be called on December 17 at 10am.

The case has been adjourned to next Monday for direction on filing of answers.
