Court of Appeal overturns High Court decision in drug case

A HIGH Court decision that ruled the Magistrates Court had no jurisdiction in judging and sentencing an illicit drug case has been overturned by the Court of Appeal.

The case, in which two men from Nausori were found guilty of possession of illicit drugs in 2016, was challenged by State prosecutors who found that the High Court should not have set aside the ruling by the Nausori Magistrates Court.

The accused, Saimoni Mata and Tomasi Koroituku, were charged with unlawful cultivation of 18.6 kilograms of cannabis and another count for the unlawful cultivation of 209.7 grams of the same illicit drug.
