The Constitutional Offices Commission (COC) will meet this month to discuss the tribunal that will be formed to hear complaints against suspended Chief Justice Kamal Kumar, Police Commissioner Brigadier General Sitiveni Qiliho and Fiji Corrections Service Commissioner Commander Francis Kean.
This, according to Attorney-General Siromi Turaga who also said in light of the fact it would mark the first time a tribunal was set up to hear a case against a suspended Chief Justice, there were a lot of preparations to be made.
The A-G said “full information” on the issue would be provided at the meeting.
“On the basis of the committee — on the complaints made, majority form the view there’s sufficient reason for this matter to go (to the tribunal) to determine if there is misconduct or not.
“At the end of the day, it is the tribunal that is going to decide that. They will hear the complaints, they will hear witnesses.”
Mr Turaga said after viewing the evidence, the tribunal, made up of three judges, would make recommendations to the COC who would then take their recommendations to President Ratu Wiliame Katonivere.
He said the tribunal would consist of three members. When quizzed about the makeup of the tribunal, Mr Turaga said a few names had been “thrown around”.
“There are other issues that we need to discuss because we have to also consider whether the tribunal will sit concurrently, whether we will have two tribunals or one tribunal, and the issue of how long it will take.
“Hopefully, this should be completed in less than three months.”
