Court reduces three-year sentence

A MAN sentenced to three years imprisonment for cultivating marijuana had his sentence reduced to 14 months by the High Court in Lautoka.

Emori Dibi appeared before the Tavua Magistrates Court on June 5, 2017, and was convicted for one count of unlawful cultivation of illicit drug. No minimum term was set by the presiding magistrate.

He appealed the sentence which was presided over by Justice Paul Madigan.

Justice Madigan said although the appellant was cultivating 23 plants, the weight was only 32.4 grams.

He said this attracted a sentence of 30 months imprisonment.

Taking into account the mitigating factors, Justice Madigan said the appellant had a clear record, was remorseful and had co-operated with police.

He said Dibi had also spent 22 days in custody awaiting trial and had already served eight months of his original sentence.
