Eight years in jail for killer driver

THE High Court in Suva has jailed a driver for eight years with a non-parole term of seven years.

Yesterday, Justice Salesi Temo found Subramani Goundar guilty on counts of manslaughter, not able to provide sufficient sample for breathalyser test and failure to comply with requirements after an accident.

The court heard that the consequence of his acts resulted in the death of Sairusi Vunakece, 35, who was struck down on the roadside by Goundar on April 29, 2016. The court heard Goundar was believed to be intoxicated and speeding away from police.

Goundar was jailed for seven years on first count, 12 months on second count and disqualified from holding a driver's licence for two years and 30 days imprisonment for third count.

Justice Temo said Goundar had few mitigating factors during the trial.

"Firstly he was remanded in custody for three days and secondly he has no convictions in the past 10 years," he said.

Justice Temo said Goundar demonstrated a reckless driving attitude and with this he didn't deserve to be a taxidriver.

"Because your actions have caused heartache and sadness to the family of the deceased. The deceased died on the scene with the immediate cause of death being breathing in mud, which caused blockage in his airways," he said.

The sentencing is effective from May 4 and Goundar has been given 30 days to appeal the sentencing.
