Prison time reduced

A TAVUA man convicted of burglary had his prison term reduced by three months after he appealed the decision of the Tavua Magistrates Court.

Penaia Ratu was sentenced to 21 months imprisonment after he pleaded guilty to one count of burglary and one count of theft in July last year.

However, Mr Ratu appealed the sentenced citing the court's decision to award a 15-month non-parole period.

Representing himself before Magistrate Rajasinghe, Mr Ratu argued that the resident magistrate had failed to give the accused a discount for his early guilty plea and not considering his time spent in remand.

In his judgment, Mr Rajasinghe said Mr Ratu's three-month stay in jail during the case should be considered as a prison term.

He said he would allow Mr Ratu's appeal and reduced his sentence from 21 months to 18 months.

The court also reduced his non-parole period to 10 months.
