Jail time for rape

A HEARING impaired man who was jailed for almost 10 years for raping and sexually assaulting a nine-year-old boy was yesterday told by the court that he exposed the innocent mind of a child to sexual activity at such a tender age.

Justice Riyaz Hamza made the comment while sentencing the 22-year-old man at the High Court in Suva.

The incident happened in Navua on May 12 this year.

The convicted man visited the complainant's house on the said date. At around 10.30pm, the complainant completed his homework and went to bed when a few minutes later he heard the man indicating to his (complainant) aunt that he wanted to sleep over at their house.

The court heard the man was sleeping on the same bed as the complainant when he committed the act.

In passing sentence, Justice Hamza told the convicted man he had taken advantage of the complainant's vulnerability, helplessness and naivety. The other aggravating factors in the case included the large disparity in age between the man and the complainant.

Justice Hamza told the man that he had breached the trust the complainant had in him as his neighbour.

After considering the time already spent in remand as time of imprisonment, Justice Hamza handed down a head sentence of nine years and 11-and-a-half months to be served by the man. The man will be eligible for parole after serving five years and 11-and-a-half months.
