Man freed from prison

A MAN who was serving a 12-year-sentence for two counts of rape has been freed after the Fiji Court of Appeal quashed his conviction and acquitted him of the offence accordingly.

Dineshwar Prasad was earlier convicted for raping a 21-year-old university student at an apartment in Suva on March 8, 2012 on two occasions.

Mr Prasad was sentenced on October 13, 2013 with a non-parole period of 10 years.

He then filed an application for a special leave to appeal and leave to appeal out of time against his sentence and conviction under five grounds, which were all thrown out and refused by the trial judge.

Lautoka lawyer Iqbal Khan then filed another appeal before a Full Bench at the Fiji Court of Appeal on behalf of Mr Prasad.

Mr Khan filed seven grounds to appeal against Mr Prasad's conviction and sentence.

On the first ground, the appellant claimed the learned trial judge erred in law and in fact in not adequately, sufficiently, referring, directing, putting and considering himself or the assessors the medical report of the complainant.
