A SHOESHINE boy has had a lucky break after being told he would not spend New Year's Day in jail for assaulting his sister.
Josese Sale had pleaded guilty to a charge of assault causing actual bodily harm.
The court heard that earlier this month, Sale's sister was passing by their mother's house in Valenicina settlement in Lami, when she heard someone shouting.
The court was told when Sale's sister entered the house, she saw Sale standing in front of their mother with a stick. Sale was said to have been drunk.
The court heard that Sale turned around and hit his sister on the head when she enquired what he was doing.
After this he ran away.
In mitigation, Sale said he was 29 years old and worked as a shoeshine boy earning $120 a week.
Chief Magistrate Usaia Ratuvili told Sale the court was ordering him to be of sober habits as well.
A domestic restraint order was also placed on Sale not to assault his sister, threaten her, be abusive or damage her property.
Sale was given a two-month jail term suspended for 18 months.
