THE Tavua Magistrates Court has overturned a guilty plea by a man charged with stealing ducks from a Tavua farm.
Rajesh Kumar admitted to one count of theft but according to the court, his plea was equivocal.
"After a careful perusal of Mr Reddy's submission in mitigation, it is apparently clear that the accused's plea was equivocal," said magistrate Samuela Qica.
"Accused is pleading that he had no intention to permanently deprive the owner of his ducks, an essential ingredient of the alleged offence. I, therefore, exercise my discretion and vacate his guilty plea and enter a not guilty plea against the accused."
Mr Kumar allegedly stole ducks from a neighbour's farm.
