THE High Court in Suva has rejected a request by Legal Aid Commission lawyer Seremaia Savou to have the trial dates for a rape case moved to the school holiday in August next year.
Mr Savou, who appeared before Justice Salesi Temo yesterday, is representing a man and three juveniles charged with rape.
Mr Savou asked that the trial dates be scheduled for the school holiday in August next year, however, this was not allowed.
Justice Temo said: "We cannot do that because all dates have been taken up except for the first week and last week of September next year."
The adult accused person failed to turn up in court yesterday and a bench warrant was issued for his arrest.
Mr Savou informed the court the man, the second accused in the case, was at the bus-stand when contacted yesterday morning and was on his way to court.
The matter has been adjourned to September 13.
