EVERY person has the right to health and access to facilities that are necessary to ensure good health.
This is stated in the 2013 Constitution that was released by the Attorney-General, Aiyaz Saiyed-Khaiyum, last Thursday.
The Constitution states that the State must ensure p eople have access to the conditions and facilities necessary to good health and services, including reproductive health care. It also states that a person must not be denied emergency medical treatment.
It further states that if the State does not have the resources to implement the service, it has to show that these services are not available.
"The State must take reasonable measures within its available resources to achieve the progressive realisation of the right of every person to health, and to the conditions and facilities necessary to good health, and to health care services, including reproductive health care," the Constitution states.
