A MAN who was jailed for 36 months yesterday appealed against his sentence in the High Court on the grounds that the magistrate did not consider his early guilty plea.
Martin Singh was convicted of two counts of burglary, eight of theft and another eight of damaging property. His lawyer Pita Katia yesterday argued before High Court judge Justice Salesi Temo that the magistrate "took the higher end of the tariff, and that certain mitigating factors were not taken into account when sentence was passed".
Mr Katia said his client should have been sentenced to no more than two years.
The matter has been adjourned to September 26.
