A MAN who was alleged to have raped a 21-year-old deaf and mute woman was convicted by the High Court in Lautoka earlier this week.
The man appeared before High Court judge Justice Sithambarampillai Thurairaja.
Despite the accused's claims that the complainant had consensual sex with him, Justice Thurairaja said the fact that she had made the complaint promptly and maintained her stance with her mother, police, the examining doctor and the court proved she was telling the truth.
"Considering her demeanour, I observed that she was shaken and shocked with the incident," he said.
"When it came to suggestion of consent she showed true anger on her face and conduct. The sign and body language demonstrate that she was telling the truth."
Justice Thurairaja said the prosecution had established a strong case beyond reasonable doubt and called in a trial.
