THE Director of Public Prosecution yesterday withdrew a charge of rape and robbery against a man because they could not locate the complainant.

Vereniki Batikalou was charged with one count of rape and one count of robbery.

However, at the Court of Appeal yesterday, a statement signed by the Director of Public Prosecutions Christopher Pryde stated that the DPP, pursuant to section 49 of the Criminal Procedure Decree 2009, was informing the court that the State did not intend to continue the proceedings against Batikalou.

DPP lawyer Maddona Fong informed the court that they had tried to locate the victim since last year.

Batikalou was alleged to have raped a 21-year-old woman at Cunningham in 2007.
