ALL Nations Church head Pastor Epeli Ratabacaca has made a request to travel to Australia next month.
He appeared before Justice Paul Madigan in Suva yesterday.
Mr Ratabacaca's lawyer, Filimone Vosarogo, told the court that a conference would be held from October 9 to 16.
He said his client had travelled to the UK and complied with the court's conditions.
However, Justice Madigan said while he was aware of that, he was concerned it was close to the trial date.
Mr Ratabacaca's case is set to begin on November 1.
Director of Public Prosecutions lawyer Lisiate Fotofili said he noticed from the affidavit that Mr Ratabacaca intended to travel on October 9.
However, Mr Vosarogo said his client's itinerary showed he would leave on October 6 and the conference would begin three days later.
Justice Madigan said he would have to give the State time to respond to the affidavit
The matter has been adjourned to Monday.
