Nadi man remains in jail after Court rejects appeal

Update: 4:39PM A NADI man serving a 13-year sentence for raping a seven-year-old student in 2012 will remain in jail after the Court of Appeal rejected, for the second time, an appeal against his conviction and sentence.
Mohammed Alfaz was sentenced to 13 years in 2014 and had on the grounds of errors made by the trial judge.
He also questioned the victim’s evidence saying that it needed corroboration.
In his judgement, Justice Chandana Premitilaka said the trial judge had questioned the victim prior to her giving evidence to test her competence, which he felt was enough.
Justice Premitilaka said Alfaz’s conviction was not entirely based on the child’s evidence.
He said in the caution interview, Alfaz admitted to raping the child, and this was ample corroboration to the victim’s testimony, the medical evidence of rape, and supported the victim’s evidence that she had been subjected to sexual abuse.
